Exculpatory Agreement and Release
It is expressly agreed that the use and/or operation of any Woody’s Bicycles rental bicycle and equipment by the undersigned (hereinafter referred to as “user”) is at the user’s sole risk., and user assumes any and all risk from the use and/or operation of any Woody’s Bicycles bicycle and equipment. It is further expressly agreed that Woody’s Bicycles and its directors, officers, representatives, and agents (including but not limited to any entity acting as a Woody’s Bicycles (pick-up/drop-off point) shall not be liable for any claims, demands, injuries, damages, and actions or causes of action whatsoever to the user or any other person arising out of or connected with the use and/or operation of any Woody’s Bicycles bicycle and equipment. User holds Woody’s Bicycles harmless and does hereby expressly forever release and discharge Woody’s Bicycles from any and all claims, demands, injuries, damages, actions or causes of action, and from all acts of active and passive negligence on the part of Woody’s Bicycles
The user hereby agrees that this rental period will start and end at the times and dates listed in the reservation, and also agrees to return to pick-up and drop-off location on the day the rental ends. The renter also agrees to return the rented bicycle and equipment in the same order and condition in which they were received, and agrees to be financially responsible for loss or damages to the bicycle(s) and equipment rented under this agreement, up to the full amount of replacement cost and related recovery, repair, and/or procurement expenses. The renter agrees that the credit card used to secure this rental will be charged to cover such expenses.
